Cyberpunk 2077 Developer is now Facing a Class-Action Suit

CD Projekt S.A. is now facing a lawsuit over Cyberpunk 2077. The legal dispute is being led by Rosen Law Firm, a representative of the company’s investors who alleges that CD Projekt lied about the state of the game on PlayStation 4 and Xbox One consoles.

The lawsuit seeks to recover damages for CD Projekt investors under the federal securities laws. According to Rosen Law Firm, the studio made false and/or misleading statements and/or failed to disclose that:

  1. Cyberpunk 2077 was virtually unplayable on the current-generation Xbox or Playstation systems due to an enormous number of bugs;
  2. As a result, Sony would remove Cyberpunk 2077 from the Playstation Store, and Sony, Microsoft, and CD Projekt would be forced to offer full refunds for the game;
  3. Consequently, CD Projekt would suffer reputational and pecuniary harm; and
  4. As a result, defendants’ statements about its business, operations, and prospects, were materially false and misleading and/or lacked a reasonable basis at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages.

CD Projekt could also be facing a lawsuit in its home country, Poland. This was suggested by Mikołaj Orzechowski, an attorney who affirms that the studio could’ve broken the Polish penal code in article 286 which says:

“Whoever, in order to gain financial benefits, causes another person to disadvantageously dispose of his own or someone else’s property by making a mistake or exploiting an error or inability to properly understand the action taken, shall be subject to the penalty of privation of liberty for a term of between 6 months and 8 years.”

CD Projekt certainly did release a game that did not run great on PlayStation 4 and Xbox One, the situation forced Xbox to offer refunds for the game, and Sony to remove it from the PlayStation Store. The studio also was forced to offer refunds for console versions of Cyberpunk 2077.
