As highlighted in a recent EuroGamer report, Nintendo has lost a legal trademark fight with a Costa Rican supermarket called Super Mario. The supermarket is located in San Ramon and is named Super Mario due to it being a Supermarket run by Don José Mario Alfaro González who is called Mario for short. After operating with the name for over a decade, Nintendo took an interest in the Supermarket when the owner’s son Charlito tried to renew the store’s registered trademark. In a recent post on the store’s Facebook page, Charlito claimed he filed the trademark back in 2013. It’s worth noting that aside from its name, the store and its logo bears no resemblance to Nintendo’s Mario franchise.
The full message reads:
“Thank you enormously to my legal advisor and accountant José Edgardo Jimenez Blanco who took care of the registration and the subsequent fight for the right to a trademark, For a moment we thought about throwing in the towel, how were we going to win the [fight against] such a commercial monster? More with the amount of legal documents submitted by them to ensure the victory.
Well, by that Edgardo and I stood firm and a few days ago we received the good news,” he continued. “SÚPER MARIO is here to stay.”
